TERMS OF SALE

  1. Set off: Parties to this contract are RCMSrl, with registered office in - Seriate - Via Perugino, 2 (BG), and the consumer whose personal data are indicated in the order form.
  2. Object: With this contract, the RCMSrl offers the goods and services chosen by the Customer in the order form, to be considered an integral part of the contract.
  3. Completion of the contract: The contract is finalized following the acceptance of these general conditions; the Customer will receive from RCMSrl an e-mail message that will summarize the content of your order and the reference to these conditions.
  4. Availability of the goods: The Customer can only purchase the goods present in the catalog published on the site www.everlinespacosmetics.com and in the quantities present in the warehouse. Should the order exceed the quantity present in the warehouse, the purchase will be accepted for the quantity of goods available, and the Customer will be informed via e-mail or telephone of any future availability of the goods and of the supply times.
  5. Fee and payment methods: The Customer will pay a RCMSrl the price agreed in the order form. The total price is inclusive of VAT and net of any other legal charges. Delivery costs will be calculated automatically and will be summarized on the order confirmation page. Delivery costs may vary depending on the payment method chosen by the customer and the country of destination. The details relating to the composition of the total are indicated in the "order detail" sent by e-mail and can be consulted at any time through the user profile . If the goods are to be delivered abroad, any additional costs due to taxes or duties provided for in the legislation of the state of destination of the goods will be charged to the consumer.
  6. Delivery time: RCMSrl through its supplier, it will deliver by courier or trusted freight forwarder within 5 working days from the order to the address indicated in the order form. However, the Customer expressly accepts to receive the goods even in case of delivery within 15 working days from receipt of the order. The aforementioned delivery times refer to the products in the warehouse at the time of the purchase order. No responsibility can be attributed to the supplier and a RCMSrl for delays in delivery of goods due to unforeseeable circumstances or force majeure.
  7. Customer Obligations: The Customer with the acceptance of this contract declares to have read and accepted in all its parts the offer of the product specifications and the general conditions of the contract. It will be the Customer's responsibility to print and keep this contract. The Customer declares that he has not entered false or fictional data in the order form, and therefore declares that the data entered correspond to his real personal data. RCMSrl reserves the right to pursue any violation and abuse in the appropriate offices. The obligations assumed by the Customer in this article as well as the guarantee of successful payment made by the Customer pursuant to art. 5 have essential character for RCMSrl, which reserves the right, in the event of non-fulfillment of one of the aforementioned obligations, to terminate the contract by law, without prejudice to any right to compensation for damage.
  8. Communications: Any communications and notifications a RCMSrl must be sent by registered letter with return receipt in advance by fax to: RCMSrl, via PERUGINO, 2 - 24068 Seriate (BG) RCMSrl he can instead contact the Customer by e-mail or telephone.
  9. Italian law and competent court: For any dispute that may arise in relation to this contract, the applicable law is the Italian one and the competent court is that provided for by Legislative Decree 206 / 05 and in art. 63, according to which the mandatory jurisdiction is of the judge of the place of residence or domicile of the consumer

 BILLING

Sales of products made through the internet are similar to mail order sales and, therefore, the provision contained in art. 2, of the DPR 21.12. 1996, n. 696, which provides for exemption from the obligation to issue a receipt or tax receipt.
For every purchase made on www.everlinespacosmetics.com , the customer can still decide whether to receive the invoice, in this case it will be necessary to enter the tax data including the VAT number and Tax Code if different. In the event that there are discrepancies in the document (incorrect personal data) or there is a need for new mailings, please contact us at the email address info@everline.it. The customer can ask when ordering that the product be sent to an address other than that indicated on the invoice. In case of withdrawal and return of the product, the Customer will receive a refund of the cost of the product and relative credit note.
